A Terceira Turma do Superior Tribunal de Justiça (STJ) decidiu que os planos de saúde devem cobrir cirurgias de feminização facial realizadas no processo transexualizador quando houver indicação médica. O entendimento da Corte é de que esses procedimentos fazem parte do tratamento de afirmação de gênero e não se enquadram nas hipóteses de exclusão previstas na Lei dos Planos de Saúde. A decisão foi proferida ao manter a determinação para que uma operadora autorizasse a cirurgia de uma beneficiária trans.
No julgamento, a operadora alegou que os procedimentos não constam no rol obrigatório da Agência Nacional de Saúde Suplementar (ANS) e, por isso, não deveriam ser custeados. A relatora, ministra Nancy Andrighi, destacou que o processo transexualizador já é reconhecido no Sistema Único de Saúde (SUS) por meio de portarias do Ministério da Saúde, reforçando que, nos casos com indicação médica e preenchimento dos requisitos legais, as cirurgias de feminização facial devem ter cobertura obrigatória pelos planos de saúde.

The Third Panel of the Superior Court of Justice (STJ) ruled that health insurance plans must cover facial feminization surgeries performed as part of the gender reassignment process when medically indicated. The Court’s ruling is that these procedures are part of gender-affirming treatment and do not fall under the exclusion criteria set forth in the Health Insurance Law. The decision was handed down while upholding the order requiring a health insurer to authorize surgery for a transgender beneficiary.
During the proceedings, the insurer argued that the procedures are not included in the mandatory list established by the National Supplementary Health Agency (ANS) and, therefore, should not be covered. The reporting justice, Justice Nancy Andrighi, emphasized that gender-affirming procedures are already recognized within the Unified Health System (SUS) through Ministry of Health ordinances, reinforcing that, in cases with a medical indication and where legal requirements are met, facial feminization surgeries must be mandatorily covered by health insurance plans.
