One thing about many of those awful anti-privacy laws is that they tend to be written such that they affect sites with a given number of users.
So currently, instances that limit themselves to a moderatable number of users (say 2⁰~1024) are completely unaffected.
That being said, pushing back against the laws *and* moving over to p2p and/or overlay networks should be considered the necessary and smart move.
