The answer seems to be the assumption that one side is smaller in number and completely committed, not caring about profit and willing to tear the house down, while the other , much more conventionally powerful side, doesn't really care about a petty technical argument and will just act to ensure their flow of fees continue. If they sense a sea change from their competitors at the last minute, they don't want to be caught without a chair when the music stops.
