My point is that if these licenses weren't considered FOSS, this gambit wouldn't work because CLA or not, those companies wouldn't be able to offer "free software" that none of their competitors can actually fork/deploy/use on ~equal footing and build a competing commercial product out of. They'd have to use a nonfree source-available license (and not get any of the brownie points and FOSS contributions) or accept that by using a FOSS license, anyone else can fork their code and deploy their own proprietary variant SaaS, losing the "commercial version" exclusivity.
