My red hot fair use copyright nuclear take is that for-profit/non-profit clauses are no longer useful in the 21st century content creator economy. A podcaster or documentarian who self-funds their own production and tries to turn a profit for sustaining it through crowdfunding is not the same kind of economic structure as say, PBS and Ken Burns. I say this as someone who used to have to explain fees as a university-based archivist and am now on the other side of the table.
