I'm not seeing any legal unclearity regarding LLMs in that aspect (diffusion models is a whole different matter though). The legal uncertainty that exists is a bit different - whether the output from an LLM can have copyright itself. I'm slightly surprised there's not more debate around that here since it's a double edged sword. Corporations currently spending money on creating things they don't hold copyright to - and copyleft authors putting invalid licenses on their work.
(I license everything I produce with LLMs as CC0 for precisely that reason)
