According to Cannon, the U.S. v. Nixon court simply did not settle the issue of whether the AG has the authority to appoint a special prosecutor to investigate and prosecute a U.S. President. She said that any discussion of this power in U.S. v. Nixon was a just “dicta”, comment not central to the decision itself. She is wrong, and I’ll say why, but the most significant thing about this move is the attempt to vindicate a position roundly rejected by the Supreme Court. 14/
