They could be said to be advertising if it is mentioned in their version string, though, presumably one could both be awaiting activation and not actually advertising it (whether this is the case for any nodes is probably unlikely but possible). You might get to define it as observing if you'd like, or they're just "running BIP-110" as they are at the very least running the code that monitors for its activation, at which point they'd begin enforcing.
