The Constitution does not have a provision that permits the use of executive orders. That power was enabled by congress.
Orders based on presidential powers not authorized by Congress are more likely to raise separation-of-powers concerns. In these cases, courts must determine whether the president has exercised legislative power belonging only to Congress.
