It's completely arbitrary. You want to claim Android isn't Linux and are working backwards from it making standards which you don't apply consistently elsewhere. Ubuntu does not have a small amount of patches but rather entirely maintains their own LTS kernels with whatever they want to backport including arbitrary features. Android is closer to using a standard LTS in production than Ubuntu, so is Ubuntu not Linux?
