That's a nice theory, but the harsh fact is that jail and prison space is _severely_ limited. Including my deep Red state part of flyover country. Politicians have decided there are better ways to buy votes.

So even if they're not soft on crime, or ethnocentric, judges can only _try_ to triage the perps who come before them, and they _will_ make mistakes. Which assumes if they had perfect foreknowledge there would even be enough space for the worst of the worst, which is probably not true in general.

Compare to a bartender kicking out a patron who just goes to another bar, albeit the second bartender probably has better clues.
