Identifying the problem with the current system is not predicated upon having a solution with which to replace it.
Many theories have been proposed, with the one you laid out being one of the more popular ones.
In 1990, there was no market demand for an iPhone. In 2020 (just 30 years later), you have a different story. My point being: until a solution finds and/or is permitted to fix a problem, it would be a fool's errand to get into every nuance of what an alternative system would look like. This does not negate the original premise that it is immoral to lock somebody in a cage for DUI.
