I agree that there's a possibility that LLM generated code will turn out to be ineligible for copyright. That's why I "license" all code I've used LLM aids when creating as Creative Commons Zero, being the closest thing to stating "I don't claim copyright".
Other maintainers have other opinions.
Regarding whether code someone submits to a project is clean of license violations that's always on the submitter regardless of the tools used.
