Securitize is urging a court to dismiss tZERO's patent counterclaim, arguing that the patents in question are invalid. According to FinTech lawyer Ariel Givner, Securitize has filed a motion to dismiss the counterclaim, asserting that five tZERO patents ('560, '496, '802, '078, and '996) are invalid under Section 101 of the U.S. Alice standard. Securitize contends that the patents, which cover areas such as custody, compliance checks for securities transfers, investor status updates, and whitelisting restrictions, represent traditional economic activities. These activities, Securitize argues, are merely implemented in a computer environment using known blockchain technology without improving the underlying technology itself. Securitize is requesting the court to dismiss tZERO's counterclaim and prohibit its re-filing.
