Yeah, I believe that relay operators have the right to own user's notes. It is very easy to transmit a billion nonsense notes. That's not a useful service. The real value is in storing notes with some kind of value. That way people actually want to use the relay.
This still can't prevent people from simply talking with eachother on a different relay, so that's not an issue. But it does solve some of Nostr's biggest problems.
