Any platform built on a partnership with the surveillance state testing ground of the west doesn’t seem like a good place to me!
UpScrolled markets itself as the privacy-first alternative to Big Tech — no data selling, no AI training, no surveillance profiles. Those are strong commitments. But when you look closer at what's actually verifiable, some important gaps emerge.
The data storage question. UpScrolled says its data "is not in Australia" and moved its HQ to the Netherlands for GDPR protection. But they haven't disclosed: where servers actually are, which cloud providers they use, whether their Australian entity (Recursive Methods Pty Ltd) still has data access, or what role Australian-based staff play in operations. "Not in Australia" isn't transparency — it's a geographic negation.
The Australian surveillance problem. Australia's TOLA Act (2018) can compel any "designated communications provider" operating in Australia to build backdoors into encrypted communications — with gag orders preventing disclosure. The under-16 social media ban and expanded eSafety Commissioner powers (2025–2026) can force platforms to collect identity data for age verification and hand internal documents to regulators. These laws use deliberately vague language ("reasonable steps," "proportionate") that maximizes government discretion.
The contradiction. UpScrolled promises minimum data collection and no surveillance profiles. Australian law can override both — silently. The Dutch B.V. structure offers partial GDPR protection, but if the Australian entity retains any data processing role, TOLA can reach it regardless of where data is stored.
What genuine transparency would look like: 📌 A transparency report (government data requests received) 📌 A warrant canary (have they received secret orders?) 📌 Named cloud infrastructure providers 📌 Clear statement on whether the Australian entity has data access 📌 Concrete retention timeframes (not "legally minimal") 📌 Independent audit results
Bottom line: UpScrolled's privacy commitments are meaningful on paper. But the platform operates across two jurisdictions with conflicting obligations, and the same vagueness that characterizes Australia's surveillance laws is mirrored in UpScrolled's own language about infrastructure and compliance. Until they provide verifiable evidence — not just marketing claims — users should treat the privacy promises as aspirational, not guaranteed.
