The point of the question is not about if BIP-110 fixes all spam - no single change can prevent all spam, and BIP-110 certainly doesn’t stop all spam. What it does is disrupt some common existing spam patterns so spammers need to adapt and more importantly send a message to VCs that spam is not welcome. The point of the question is that there’s no rule change in the BIP that should impact anyone other than spammers. So if people are worried about a chain split they should adopt BIP-110 and the risk of a chain split is gone if enough people adopt it.
