携程垄断案，靴子落地了！
7月25日，市场监管总局依法对携程集团有限公司（以下简称携程）滥用市场支配地位实施垄断行为作出行政处罚，罚没款合计51.79亿元。
这规范警示所有平台企业，无论是简单直接的“二选一”，还是隐蔽复杂的“技术+生态+行为”复合型垄断，都逃不过反垄断利剑，监管部门绝不允许以任何形式滥用市场支配地位实施排除、限制竞争行为。
**携程垄断案的查处是平台经济反垄断常态化监管的又一重大标志性案件，是新型垄断行为首案，也是深入整治“内卷式”竞争，推动平台企业和平台内经营者、劳动者共赢发展的典型案例，对推动我国平台经济创新和健康发展，以及经济社会高质量发展都具有重要意义。**
携程是我国目前最大的在线旅游平台。经市场监管总局调查，携程要求“特牌”酒店开展独家合作，构成限定交易行为，强制“金牌”“无牌”酒店给予“全网最低价”，构成附加不合理交易条件行为，并且这两种垄断行为覆盖广、时间长、影响大。细看处罚决定：责令携程停止违法行为，全额退还强制扣除酒店经营者的订单储备金1.22亿元；没收违法所得16.58亿元；处以其2025年中国境内销售额469.58亿元7.5%的罚款，计35.21亿元。这是我国平台经济领域反垄断同时给予三种处罚的第一案。监管部门综合考虑涉案违法行为的性质、情节轻重、持续时间等因素作出处罚决定，于法有据、过罚相当、宽严相济，彰显了反垄断执法的严肃性、权威性、有效性。
**反垄断执法的最大价值，并不在于高额罚款，而在于疏通被垄断行为淤塞的公平竞争机制，释放强烈的政策信号。此次查处携程丰富了平台经济领域反垄断执法的案例，发出了强烈的反垄断常态化监管信号。“独家合作”剥夺了酒店商家跨平台经营自主权，排除、限制了其他平台公平参与市场竞争，阻碍要素自由流动。“全网最低价”严重挤压酒店经营利润，消费者短期得到的是品质“缩水”的产品和服务，长期将被动承受隐性垄断溢价，陷入“前期享低价、后期付高价”的陷阱。恢复竞争，让市场机制重新发挥资源配置的决定性作用，可以促使经营者创新，增进消费者福利。近年来，我国持续完善平台经济反垄断监管体系，逐步构建起“事前合规引导、事中常态化监管、事后依法惩戒”的全链条监管机制，查处一系列重大案件，彰显了我国维护市场公平竞争、护航平台经济高质量发展的坚定决心。**
实践证明，反垄断不仅是保护公平竞争秩序的重器，也是深入整治“内卷式”竞争的利器。去年底召开的中央经济工作会议以及今年4月28日召开的中共中央政治局会议都强调，深入整治“内卷式”竞争。在一些行业，头部平台为垄断动用不正当手段，是加剧“内卷式”竞争的关键。查处携程垄断案也发出了深入整治“内卷式”竞争的强烈信号。“全网最低价”迫使其他竞争性平台和酒店经营者逐底竞争，形成了低层次、同质化的不良竞争生态。值得注意的是，携程并非个例，“平台赚钱、商家薄利、劳动者负重”的恶性循环在网络外卖、网络货运等领域具有一定普遍性。平台经济是数智技术与业务生态的深度耦合，平台“内卷式”竞争对行业的损害是系统性的，会导致行业整体利润下滑、创新动力不足、生态持续恶化。反垄断执法正是要打破低水平竞争循环，推动行业从“价格战”转向“价值战”，形成“优质优价、良性竞争”的正向循环。
当前我国平台经济发展正处在关键时期，查处携程垄断案的背后还有一个深刻的时代议题——如何推动平台企业和平台内经营者、劳动者共赢发展？平台经济发展到新阶段，头部平台凭借技术、资本和数据优势，在各自赛道上构建起坚固的壁垒，逐渐从昔日的交易撮合者、创新颠覆者，演变为规则制定者、流量分配者。如果没有有效的外部制衡，任何一家平台具有市场支配地位后，都有制定利己规则，最大化攫取行业价值的冲动。平台本是撮合供需的“桥梁”，却可能异化为雁过拔毛的“关卡”。平台经济的高速增长，如果是以牺牲平台内经营者利润与消费者权益为代价的“伪效率”增长，将影响国民经济平稳运行。平台企业与平台内经营者、劳动者、消费者本是命运共同体，让各方都能基于市场的正常逻辑公平分享发展红利，实现共赢发展才是长久之计。这既需要政府“有形之手”精准发力，也需要平台放弃流量收割模式，主动创新，积极赋能。
反垄断主要是及时校正平台行为，更是保护平台经济生态。平台企业可以做大做强，但不可以垄断称霸。对平台经济的监管，要坚持监管规范和促进发展并重，不断建立健全平台经济治理体系，构建有活力、有创新力的制度环境，推动平台经济发展迈上新高度，推动经济社会高质量发展再上新台阶。
