Actualmente, muchos bancos en EE. UU. todavía tienen miedo de interactuar con Bitcoin debido a la Operación Choke Point 2.0 (una presión informal de los reguladores para que los bancos no den servicio a empresas cripto).
* Sin la ley: Un banco puede decidir no custodiar Bitcoin simplemente porque teme que la SEC o la Reserva Federal les sancionen por "riesgos imprevistos".
* Con la ley: Al clasificar a Bitcoin por ley como Mercancía Digital bajo la CFTC, se elimina la duda. Los bancos tendrán un manual de instrucciones legal (un safe harbor) que les permite ofrecer custodia de Bitcoin a sus clientes sin que un regulador pueda decirles que es "peligroso" o "ilegal".
