《关于离岸信托个人所得税有关事项的公告》（财政部 税务总局公告2026年第21号）全文总结
一、出台目的与适用定义
1. 立法目的：依据个人所得税法，规范离岸信托全流程个税征管，封堵利用离岸信托递延、规避个税的漏洞。
2. 离岸信托定义：境外法律设立的信托或实质具备信托功能的境外架构；持牌金融机构标准化理财产品除外。
3. 财产装入信托认定：直接转移至信托/受托人控制境外实体、借他人代持但本人实际出资控制，均认定为装入信托；动产、不动产等全部财产纳入征税范围。
二、居民个人离岸信托全环节征税规则（核心）
1. 资产装入环节
居民个人把财产转入离岸信托，按财产转让所得计税，应纳税所得额=装入时市价-财产原值-合理费用；完税后信托内资产原值更新为装入市价。
2. 信托存续年度（颠覆性规则）
信托及其控制的境外实体当年产生收益，无论是否实际分配，当年必须申报个税：
- 财产增值转让：财产转让所得；股息、利息：利息股息红利所得；两类收入不得互抵，亏损不能跨年结转，信托管理费等各类服务费不得税前扣除；
- 已完税收益后续分配不再重复征税；境外已缴同类税款可抵免境内应纳税额；
- 明确“境外实体”判定标准，对被动收入占比高、无实质经营、受个人控制的境外公司穿透征税；25%以上持股即构成控制。
3. 信托终止清算
清算全部收益按利息、股息红利所得计税；终止当年存续期收益单独按年度规则申报。
4. 特殊身份变更一次性清算征税
1. 居民转非居民（移民/拿境外永居）：转换当日信托资产增值一次性计税，完税更新资产原值，后续按非居民规则管理；
2. 居民委托人离世：由受托人代为申报清算个税；其他居民承继信托则继续适用居民信托规则，非居民承继则按非居民信托管理。
三、非居民个人离岸信托征税规则
1. 非居民装入离岸信托，仅就来源于中国境内财产转让所得缴税；若信托实际由居民控制，直接按居民信托规则征税；
2. 信托向居民分配收益、或收益由居民实际占有使用，居民按利息股息红利所得纳税；
3. 四类向居民输送经济利益情形（担保借款、无偿使用资产、第三方输送利益、向关联方让利），视同分配收益计税；
4. 信托终止、居民承接信托财产，以财产市价作为应税所得计税。
四、多人共有信托处理
1. 多名居民共用信托：按各自投入资产市价比例分摊收益、分别计税；
2. 居民+非居民共同装入同一信托：整体视同居民个人信托，全额适用居民征税规则。
五、申报期限、分期缴税与估值管理
1. 申报时限
- 居民装入信托：次年3.1-6.30申报；
- 年度存续收益：每年3.1-6.30汇算；
- 信托终止、移民、委托人离世：次月15日内申报；
- 非居民装入信托：次月15日内申报。
2. 分期缴税：缴税困难可备案后5年内均匀分期缴纳。
3. 资产估值：纳税人无法提供公允价，税务机关可委托第三方评估；无法证明合理商业目的，税务机关有权调整应纳税额。
六、历史存量补缴宽限期（过渡期政策）
1. 2023.1.1—2025.12.31存量未缴税款：公告发布起90日内申报补缴，免收滞纳金；逾期追缴并加收滞纳金，偷逃税依法处罚；
2. 2026年1月1日起新设、存续离岸信托，严格执行本公告新规。
七、实施时间
公告自2026年7月24日发布之日起施行。
