### 「社会寄生虫」罪
言九林 2026年5月3日
1961年5月4日，俄罗斯苏维埃联邦社会主义共和国颁布了一项法令，名为《关于加强打击逃避社会有用劳动和过着反社会、寄生性生活方式的个人》。内中写道：
「无论是在城市还是乡村，依然存在着某些个人——尽管他们体健力壮、具备劳动能力——却顽固地拒绝从事诚实的劳动，过着反社会、寄生的生活方式。在集体农庄中，此类人员在享用为集体农庄庄员设立的各项福利的同时，却逃避诚实劳动，破坏劳动纪律，从而给集体经济造成损害。……必须对反社会、寄生分子开展坚决的斗争，直至这种可耻的现象从我们的社会中彻底根除。为此，必须在这些人的周围营造一种绝不容忍、全民共诛之的社会氛围。」
依据该法令，凡无工作者、或有工作但并非政府认定的「有用劳动」者，皆属于过着「寄生性生活」。警察机构或其他政府相关组织会对此类人群做出警告，告知其必须在一个月内落实就业。否则就将受到所在地区法庭的裁决，要被判处流放西伯利亚劳动改造二至五年。此类判决一旦做出，皆属于终审裁定，不得上诉。此外，每年失业超过四个月之人也将被追究刑事责任，唯一的例外，是有年幼子女需要抚养的家庭主妇可短暂免于工作。

「打击社会寄生虫运动」与苏联上世纪二十年代末三十年代初实施的「集体农庄制度」密不可分。
「集体农庄制度」下，农民失去了土地，也失去了土地产出物的支配权，随之而来的自然是消极劳动与大饥荒。问题是，大饥荒再如何惨烈，「集体农庄制度」也不会被视为错误，不存在被取消的可能性。于是，「社会寄生虫」就成了官方竭力宣传的「病因」。1948年1月17日，主政乌克兰的赫鲁晓夫向斯大林递交了一份备忘录。内中写道：
「许多集体农庄里仍然有人顽固地拒绝从事对社会有益的工作，像寄生虫一样依附在诚实的集体农庄成员身上。一些寄生虫和犯罪分子依附于集体农庄，享受着集体农庄提供的各种福利，却不参与集体农庄的劳动。……1946年，乌克兰有86676名集体农庄成员一天都没干活。在1947年夏季最繁忙的收割季节，例如在文尼察州的集体农庄，超过4.5万名身强力壮的集体农庄成员无故旷工，他们并未达成法律规定的最低工作日数。在卡缅涅茨-波多利斯基州和日托米尔州，有超过2万名身强力壮的集体农庄成员未达到最低工作日数。……这么多集体农庄成员未能达到最低工作日数，很大程度上可以归因于敌对和寄生分子的影响。」
在赫鲁晓夫看来，目前用来打击「社会寄生虫」的手段力度严重不足，「六个月的强制劳动刑罚」对消极劳动者根本起不到威慑作用。他建议斯大林大幅提升处罚力度。于是，1948年2月21日，苏联最高苏维埃主席团签署了一项名为《关于将恶意逃避农业劳动、过着反社会、寄生性生活方式的人驱逐出乌克兰苏维埃社会主义共和国》的法令。依据该法令，村苏维埃拥有了通过「集体投票」方式流放「拒绝好好劳动」的村民（55岁以下）的法律权力。流放地为乌克兰的偏远地区，期限为八年。要在流放地劳动改造满五年，才能提出返回家乡的申请。

新法令的效果似乎很不错，农民们出现在集体农庄的数量和频率都有增加。1948年12月18日，乌克兰官方向苏联部长会议报告说：哈尔科夫州的列宁之路集体农场，之前每天只有35-40人在岗，如今每天约有150人在岗。整个哈尔科夫州，之前每天只有14万人左右在集体农庄劳动，如今已经增加到了24万人。新法令也推行于其他加盟国。据苏联集体农庄事务委员会1948年9月3日提供的报告，俄罗斯布良斯克州的克拉斯尼卢奇集体农场，原本一般只有100-110人报到，如今报到人数已经增加到285人。
整个1948年，乌克兰有超过27000人被当作「消极劳动者」「社会寄生虫」流放。没人在意其中存在大量老人、病人与残疾人。各级政府的报告也往往只提「在岗人数」增加了多少，刻意回避了集体农庄的效率与产量并无起色。
大概是对自己在乌克兰打击「社会寄生虫」的经验颇为得意，赫鲁晓夫入主莫斯科后多次颁布类似法令。1956年，他曾以「游手好闲」为由，下令禁止吉普赛人在苏联境内自由迁徙。1957年，他又要求制定《加强打击反社会、寄生分子》法律草案，试图将城市中的「消极劳动分子」挖出来流放。法律专家们提醒赫鲁晓夫，该草案违反了苏联签署的国际劳工组织公约。公约明确禁止政府使用任何惩罚手段，去强迫任何人从事任何他不愿意的劳动。出台这样的法律，将严重损害苏联的国际形象。
事情拖到1959年7月，在莫斯科郊外举办的美国国家展览会上（根据美苏文化交流协定，为展示各自的制度优越性，两国将在对方境内举办博览会，苏联已于1959年6月在纽约举办了展览），赫鲁晓夫与来访的美国副总统尼克松发生了著名的「厨房辩论」。期间，尼克松提到莫斯科有许多黑市商人和游手好闲者。
这段话刺激到了竭力想要论证苏联制度远比美国优越的赫鲁晓夫。于是，国际劳工组织公约不再重要，打击「社会寄生虫」的立法工作再次紧锣密鼓推进。结果便是1961年5月正式公布的法令——《关于加强打击逃避社会有用劳动和过着反社会、寄生性生活方式的个人》。

三个月后，1961年8月16日，苏联官方提供了一份报告摘要。内中写道：
「据俄罗斯苏维埃联邦社会主义共和国检察院统计，截至1961年8月1日，俄罗斯联邦境内已查明13万人过着反社会、寄生性生活方式……法令公布并开展宣传工作后，大多数逃避社会劳动的人员开始在企业、建筑工地以及集体农场和国营农场工作。」
报告还提到了一些案例。焊接工程师瓦西连科不愿为国家从事「有益工作」，在1947年选择辞职去办养兔场。靠着卖兔子皮和兔子肉过上了对社会毫无益处的好日子。政府机构派人去警告并勒令他必须从事「有益工作」后，仍阳奉阴违，找了一份保安兼马夫的工作为幌子，仍继续经营养兔场。于是地方法院判决瓦西连科流放改造五年，并没收了他的房子（1栋）、母牛（1头）、公牛（1头）和兔子（340只）。
伊格纳托夫是消防员，拿着31个卢布的月薪，却将主要精力放在了耕种自留地、在市场上卖水果蔬菜等事情上。靠着这些「无益工作」买了两辆小汽车，盖了两栋小房子。地方法院秉公执法，判处伊格纳托夫流放改造五年，并没收所有财产。

1964年初某日，后来的诺贝尔文学奖得主、诗人布罗茨基（1940-1996）正在家中写作，突然有警察上门，警告他必须在某个具体时限之前找到一份工作，否则法院将以「社会寄生虫罪」起诉他。
类似的经历也发生在历史学家罗伊·梅德韦杰夫（1925-2026）身上：「他们想以寄生虫罪起诉我。我当时……失业在家，他们威胁要根据这条法令起诉我。我回答说：我靠自己的钱生活，我在国外出版书籍，并通过外商银行合法收取版税。但他们威胁说：你没有工作，我们要以寄生虫罪起诉你。」
这些恐吓「的不虚示」。1963年6月，莫斯科大人物列昂尼德·伊利乔夫曾严肃警告过民众：「想劳动就劳动，不想劳动就不劳动——在我们这里，这种选择无从谈起。我们的法律不允许这种选择存在。」
1963年11月29日，《列宁格勒晚报》刊登了一篇题为《文学寄生虫》的批判文章，点名道姓痛骂布罗茨基，说他「不爱祖国」，说他的诗歌「简直是胡言乱语」，说他「过着寄生虫似的生活。身体健康的二十六岁青年，将近四年没有从事任何对社会有益的劳动。他依靠零工生活，甚至向父亲伸手要钱……」文章呼吁全社会不要再纵容布罗茨基这种沉迷文学的寄生虫，「像布罗茨基一样的人，在列宁格勒没有容身之处！」
1964年，捷尔任斯基地方法院判决布罗茨基「社会寄生虫罪」成立，强制流放至西伯利亚偏远劳改营服苦役五年。后因国际影响恶劣，刑期缩短至18个月。

布罗茨基被流放之前五百六十六年，是中国的洪武三十一年。这一年，朱元璋颁布《教民榜文》，大开地图炮，痛骂河南、山东等地百姓被前朝坏风气影响，「有等懒惰、不肯勤务农业，以致衣食不给」，宁可让土地荒芜，宁可吃不饱饿肚子，也不愿勤劳耕作。为了打击这些「懒汉」，朱元璋设置了「里老人」，勒令他们担负起监督职责——农耕时节，每天五更擂鼓。鼓声一响，所有百姓便必须起床下田，由里老人负责清点人数。懒惰不肯下田者，里老人有权用「竹篦荆条」抽打。朱元璋还警告道：里老人务必严格监督百姓下地，不许迟到早退，若有「游食」之人被官府抓到，必定严惩，里老人也要一并连坐。
在朱元璋那里，「勤劳」不是美德，是义务。
