美国国会针对中国汽车产业的限制措施进一步升级。参议院商务委员会星期三（7月22日）一致通过跨党派《联网车辆安全法》（Connected Vehicle Security Act），拟全面禁止包括中国在内的“外国敌手”（Foreign Adversaries）的联网汽车、软件、硬件及关键零部件进入美国市场。提案议员表示，法案若最终成为法律，即使中国联网汽车经加拿大或墨西哥进入北美，也将不得驶入美国。
这项法案由共和党联邦参议员伯尼·莫雷诺（Bernie Moreno）和民主党联邦参议员埃莉萨·斯洛特金（Elissa Slotkin）共同提出，被视为美国近年来针对中国汽车产业最严厉的立法之一。除中国外，法案列出的“外国敌手”还包括俄罗斯、伊朗和朝鲜。
法案将在拜登政府此前出台的联网汽车限制规则基础上扩大监管范围，禁止进口、制造、销售和转售与中国等“外国敌手”有关的联网汽车，以及相关软件、硬件、车载数据系统和关键零部件，范围还包括由合资企业或受相关国家控制实体开发、制造的产品。
同时，法案授权美国商务部识别并禁止可能危及美国国家安全和经济安全的高风险汽车技术、零部件及相关交易，并建立相应执法机制。
提出法案的俄亥俄州共和党联邦参议员莫雷诺在接受美国之音（VOA）采访时表示，法案旨在防止被美国列为“外国敌手”的国家借助联网汽车威胁美国国家安全，并冲击美国汽车产业。
“我认为，这项法案的目标在于确保那些被列入‘外国实体关注名单’的国家——显然中国目前就在该名单上——不会摧毁我们的汽车工业，并危及我们的国家安全，”莫雷诺对美国之音说。
莫雷诺参议员出身汽车行业，对美国汽车产业十分熟悉。他早年曾在通用汽车旗下土星（Saturn）品牌工作，后转入汽车零售业。2005年迁居俄亥俄州后，他创办并发展汽车经销企业，旗下拥有十余家汽车经销店，成为当地知名汽车经销商。进入国会前，他已出售全部汽车经销业务。
莫雷诺表示，汽车产业是美国工业经济的支柱，国会必须在“为时已晚之前”通过立法限制中国联网汽车进入美国市场，否则美国可能重蹈一些西方国家制造业衰退的覆辙。
“（如果不采取行动，）我认为，最终我们会走上许多其他西方国家走过的老路，那就是彻底摧毁本国的工业基础。我们绝不会让这种情况发生，”莫雷诺说。
谈及国家安全风险时，莫雷诺认为，联网汽车能够持续采集用户身份、行驶轨迹及车载影像等敏感数据，并具备远程控制能力，一旦相关技术受中国法律约束，可能导致数据外流甚至车辆遭远程操控。
“根据中国法律，你驾驶这辆车去过的每一个地方，相关数据都必须上报给中共，”莫雷诺这个月早些时候在美国企业研究所一场活动上说。“如果这还不够，那再补充两点：第一，这些车装有摄像头，会将你所到之处的视频发回。所以，如果你在敏感的军事基地工作，那就糟糕了。”
“所有汽车都可以被远程控制，只不过西方汽车企业受到严格法律约束。试想一下，当你正行驶在宾夕法尼亚大道上，有人远程控制了你的车辆，你将无法控制方向、油门或车门锁，车辆可以被操控驶向任何地方。这显然是一个严重的国家安全威胁。”
来自汽车工业重镇密歇根州的民主党联邦参议员加里·彼得斯（Gary Peters）在委员会审议时表示，《联网车辆安全法》不仅关乎国家安全，也有助于维护美国经济安全。他认为，中国通过政府补贴、低价倾销以及不公平贸易和劳工政策扭曲市场竞争，这种模式此前已出现在华为和大疆等行业，如今正延伸至汽车产业，并已影响欧洲和拉美市场。
“《联网车辆安全法》是一道重要屏障，防止中国共产党在美国操纵市场，确保所有汽车制造商，无论国内外，都能在公平的竞争环境中展开竞争，”彼得斯在会上说。
来自伊利诺伊州的民主党联邦参议员塔米·达克沃斯（Tammy Duckworth）在会后接受美国之音采访时强调，法案另一项重要目标是强化美国汽车供应链。
“这关乎发展美国的供应链，”达克沃斯对美国之音说，“在新冠疫情期间，我们意识到供应链的许多环节都依赖于外国制造商。因此，无论这种依赖是来自与我们竞争的对手制造商，还是来自友好的制造商。”
行政限制升级为联邦法律
美国政府近年来持续收紧针对中国汽车产业的限制。2019年，特朗普总统签署行政命令，宣布外国对美国信息与通信技术供应链构成的威胁进入国家紧急状态，为联邦政府采取相关限制措施提供法律依据。拜登政府随后沿用这一法律授权，并于2025年1月敲定联网汽车监管规定，禁止与中国和俄罗斯有关联的联网汽车软件和硬件进入美国市场。
如果《联网车辆安全法》最终获国会通过并由总统签署生效，现行主要依靠行政法规实施的限制措施将上升为联邦法律，未来政府若希望通过行政命令放宽或撤销相关限制，将面临更高法律门槛。
根据法案，针对联网汽车及相关软件的限制将于2027年生效，硬件限制则于2030年实施，以为美国汽车产业调整供应链预留过渡期。
与拜登政府的行政规定相比，新法案不仅将现行限制措施法制化，还进一步扩大监管范围。除基本延续对中国联网汽车进入美国乘用车市场的限制外，法案还明确禁止与中国相关的联网汽车、软件、硬件及关键车辆技术进入美国市场，并赋予商务部更大的执法权限，以堵住潜在监管漏洞。
中国联网车全面禁入美国
莫雷诺表示，法案一旦成为法律，来自加拿大或墨西哥的中国联网汽车也将不得进入美国。
“他们会直接被挡在边界，”莫雷诺在回答美国之音提问时表示，在加拿大或墨西哥驾驶中国联网汽车的人仍可通过租车等其他方式进入美国，但“中国联网汽车在任何情况下都绝不会被允许进入美国”。
莫雷诺表示，目前计划将该法案纳入《国防授权法案》（National Defense Authorization Act，简称NDAA）推动通过。不过，他强调，无论作为独立法案还是纳入大型法案审议，这项获得两党支持的立法最终都有望获得国会通过。
众议院方面，共和党联邦众议员约翰·穆勒纳尔（John Moolenaar）和民主党联邦众议员黛比·丁格尔（Debbie Dingell）提出了对应版本法案。身兼众议院中国问题特设委员会主席的穆勒纳尔在接受美国之音采访时表示，联网汽车本质上是“移动的数据采集设备”，法案不仅关乎国家安全，也涉及公平贸易和维护美国汽车产业竞争力。

参议院商务委员会通过法案后，穆勒纳尔与丁格尔发表联合声明表示，《联网车辆安全法》对于保护美国就业、国家安全和制造业未来至关重要。
“《联网车辆安全法》对于保护美国就业岗位、国家安全以及美国制造业的未来至关重要，”议员们在一份书面声明中说，“中国汽车制造商利用强迫劳动、巨额政府补贴和不公平的贸易行为，其车辆配备了向中国传输数据的设备，对国家安全构成威胁。这些公司已经在欧洲本土市场重创了欧洲竞争对手，导致裁员和减产，我们绝不会让他们在美国重演同样的局面。”
汽车维修联盟（CAR Coalition）在提供给美国之音的一份书面声明中表达了对这项立法进程的肯定。
“政府和业界都致力于确保汽车供应链与某些国家没有任何关联，这项立法将确保这一目标得以实现，”汽车维修联盟在声明中说。
《联网汽车安全法》在通过参议院商务委员会审议后，接下来将送交院会等候全体表决。一部法案若要成为美国法律，必须经参、众两院分别表决通过文字一致的版本，并交由总统签署后方能生效。

My favorite feature are the blogs, though I like to call them magazines.
A magazine is composed of nostr events, so it’s distributed via relays and can be styled and published in multiple ways in multiple places, and all you need is the naddr of the root event, then you can reconstruct the navigation and content to build a webpage.
